Contentious Cases before the Tribunal for the Defense of Free Competition (TDLC)

  • Representation of Telefónica Móviles de Chile –as respondent– in four trials for abuse of a dominant position initiated by mobile telecommunication service providers of the Virtual Mobile Operators type, in a trial for alleged abuse of a dominant position in a contest called by the sectoral authority, and in a trial for abuse of dominant position and arbitrary discrimination, respectively.
  • Representation of Telefónica Móviles de Chile and Telefónica Chile, as required, for alleged infractions of the provisions of General Instructions No. 2/2012 of the TDLC and for tied sales, respectively.
  • Representation of the companies Young & Rubicam, Ogilvy; J. Walter Thompson; Gray S.A.; and Wunderman Communications –as respondents– belonging to the WPP Group for illicit collusion.
  • Representation of Multicaja –as claimant– in a lawsuit against Banco Estado, for abuse of a dominant position, specifically for the unlawful refusal to hire and tied sales.
  • Representation of Prosud (LG Tech detergent) and Aportas (Panda detergent) –as claimants– against Unilever Chile for abuse of a dominant position, specifically for exclusive behavior. This trial ended in conciliation between the parties, Unilever committing to cease their practices.
  • Representation of ENAMI in several claims filed against it by mining companies for alleged abuses of dominant position (purchasing power).
  • Representation of Rendic Hnos. S.A., controller of Unimarc Supermarkets, as required by the National Economic Prosecutor’s Office for abusive practices.
  • Representation of Eukor Car Carriers as required by the National Economic Prosecutor’s Office for being part of an alleged collusion in the industry of maritime transport of vehicles.
  • Representation of Embotelladora Andina S.A. in a lawsuit initiated by the franchisees of a well-known restaurant company, for an alleged abuse of a dominant position as supplier of the franchise.
